Composer sues to stop Gingrich use of song (AP)

CHICAGO ? The composer of the "Rocky III" anthem "Eye of the Tiger" is suing Republican presidential candidate Newt Gingrich to stop him from using the song at campaign events.

The federal lawsuit, filed Monday in Chicago by Rude Music Inc., contends Gingrich has used the song since 2009 to herald his arrival at rallies and public events.

The lawsuit says Gingrich uses the song without the permission of Frank Sullivan, who with Jim Peterik, composed the song and copyrighted it in 1982.

The lawsuit asks for an injunction to prevent Gingrich from using the song, as well as damages and attorneys' fees

Attorneys for the Gingrich campaign couldn't be reached for comment late Monday.

Body In Well Identified As Alexandria Activist Lenny Harris

Yemeni president heads to U.S (Politico)

The embattled president of Yemen has arrived in the United States for medical treatment.

Yemen's foreign press office says that President Ali Abdullah Saleh arrived at an unspecified location in the United States, after a journey that took him from Oman, through London.

His staff has said he is in the United States to be treated for injuries suffered during an assassination attempt in June.

Saleh's travel plans in the United States have not been disclosed for security reasons.

After months of unrest, Saleh agreed in November to relinquish power.

The U.S. and its allies have pressured Saleh to leave Yemen permanently, but it is unclear how long he will remain in the U.S.

In a speech before he left for Oman, he promised to return home before Feb. 21 presidential elections.

TAMPA, Fla. (AP) ? Greg Schiano couldn't resist the challenge of trying to transform the Tampa Bay Buccaneers into winners.

The 45-year-old architect of a stunning college football turnaround at Rutgers was formally introduced Friday as the "right man" to the lead the NFL's youngest team to playoff contention ? and beyond.

"I don't believe in doing anything except to be the best," Schiano told a packed auditorium inside the team's posh headquarters and training facility. "We're going to try to be the best starting today. How long that's going to take, I can't tell you that. ... But when our best is the best, we'll be Super Bowl champs."

Schiano took over a struggling program at Rutgers and turned it into a Big East contender during an 11-year run with the Scarlet Knights.

The Bucs are banking on him to have the same kind of impact in Tampa Bay, which has not won a playoff game since winning it's only NFL title in 2002.

"He's a person who came into a program and built it from the ground up. ... He went in there, rolled up his sleeves, cut no corners, did the hard work that was necessary to put it where it is today," Bucs co-chairman Joel Glazer said.

"He has a vision for what he wants to do, how he wants to coach football," Glazer added. "We spoke to a lot of people in football. The more people we spoke to, whether it be college or the pros or scouts, it was amazing the feedback you got."

There have been numerous suitors for Schiano over the past decade, however he said none of the opportunities seemed right for him. That is until the Bucs called during a 24-day search that began when Raheem Morris was fired on Jan. 2.

The Glazer family, along with general manager Mark Dominik, convinced Schiano they share a common vision of what it will take to build a consistent winner.

"I've been in the NFL" as an assistant, Schiano said. "I've been a head coach for 11 years. I did not need to be a head coach in the National Football league today. ... So I really studied the team, I studied the situation, I studied the ownership, I studied mark. That's what makes me comfortable" taking the job.

"There's been several opportunities to go to places that were quote, unquote bigger names or bigger programs," the coach added. "And at times I listened. But when I tried to put myself there, it just didn't feel good. ... This felt right."

The Bucs have fielded the league's youngest team the past two years with dramatically different results. After going 10-6 and nearly earning a playoff berth in 2010, they slumped to 4-12 for this season, ending the 35-year-old Morris' run as the NFL's youngest head coach on a 10-game losing streak.

A porous defense allowed 31 of more points in seven of the team's last eight games and the offense sputtered, in part because of the inconsistent play of Josh Freeman, who threw took a step back in his development with a career-high 22 interceptions after throwing just six the previous season.

Schiano was one of at least 10 candidates the Glazer family interviewed during a 24-day search. Oregon coach Chip Kelly turned down the job earlier this week, leaving Schiano, former Green Bay Packers and Texas A&M coach Mike Sherman and Carolina Panthers offensive coordinator Rob Chudzinski as finalists for the Tampa Bay opening.

"The more time we had a chance to spend with him, the more evident and clear it was that he was going to be the man to lead our football team going forward," Dominik said.

In addition to getting Freeman back on track, Schiano faces the challenge of improving a defense that yielded a franchise-record 494 points while also ranking near the bottom of the NFL in sacks and yards allowed.

The Bucs used first- and second-round selections in each of the past two drafts to rebuild the defense line, yet still have not been able to generate a consistent pass rush.

Schiano was a defensive assistant in the NFL with the Chicago Bears for three seasons and was the University of Miami's defensive coordinator for two years before moving to Rutgers.

"You talk about how our team is going to look. ... Our team will be built around a humble, unselfish, attitude and sacrifice," Schiano said. "It's hard to find that in today's world. But that's who we'll be."

This season revealed glaring weaknesses throughout the team. Still, Schiano likes the foundation that Dominik and Morris laid the past two years.

"It a young core of very talented guys. But until you actually coach them, how do you know how talented? I've watched video, I talked to people I know in the National Football League and I'm very impressed," he said, adding that he's confident he'll be able to assemble a coaching staff that will help players grow.

Can Demi really be suffering from exhaustion?

Why do celebrities such as Demi Moore say they are being admitted for "exhaustion" when there is no insurance company in the world that will pay for someone to "rest up" and no one really believes the diagnosis of "exhaustion" anyway? Why say anything at all? --?Mallie K., via Facebook

I've interviewed a range of doctors, from straight-up M.D.s to addiction specialists, and they all agree with you: If you think insurance is going to reimburse you for weariness, good luck with that. Celebrities aren't fooling anybody with that old saw, either. But there's a good reason why they use the same unbelievable language time and again ...

Moore is the latest in a long line of celebrities to announce treatment for exhaustion. Tracy Morgan's rep claims that the comedian's recent out-passing at Sundance was partially exhaustion-related. Lady Gaga has claimed a bad romance with the same problem. Mariah Carey, Dave Chapelle -- the list goes on and on.

It would all make a lot of sense, except, medically, it doesn't.

"Exhaustion is a symptom," confirms Andrew Spanswick, founder of the KLEAN Treatment Center in West Hollywood.

In saying this, Spanswick echoes the conclusions of many kinds of health experts I have spoken with, including Steven Krems, a doctor at the Centinela Freeman Regional Medical Center, who told me several years ago that "It's not a medical diagnosis. It's a symptom ... Exhaustion is how they are feeling, [not] whatever it causing it, whether that is drugs, anemia, pneumonia, whatever."

In other words, saying that you're seeking treatment for exhaustion is like saying you're seeing a doctor for sneezing. You're sick with something else. The sneezing is the sign.

So why do stars keep using the term? Because, in Hollywood, at least, it's a kind of code. It's shorthand for "Feeling Like Garbage, None of Your Business."

"The celebrities are balancing between an obligation to disclose things to the public versus protecting their rights to privacy," Spanswick says. "Smart publicists will use words like 'exhaustion' to minimize potential damage or gossip within the media but also protect a star's privacy rights."

That is, assuming that anyone even believes that word anymore. And assuming that the star even knows what she's suffering from in the first place.

"They may not know what the problem is yet," Spanswick very reasonably points out. "Or they may be in denial of what their problem might be."

As for exactly what Moore is suffering from, well, this is Hollywood. We'll find out on "Ellen" eventually.

The Economic Blueprint Does Not Begin with American Manufacturing (ContributorNetwork)

COMMENTARY | In his State of the Union Address, President Obama made it clear that the blueprint for American economic success begins with manufacturing. He stated: "So we have a huge opportunity, at this moment, to bring manufacturing back. But we have to seize it. Tonight, my message to business leaders is simple: Ask yourselves what you can do to bring jobs back to your country, and your country will do everything we can to help you succeed."

The fact of the matter is, nothing could be further from the truth. This is not to say that American manufacturing workers are not the smartest and hardest working manufacturing workers in the world. But they are incredibly overmatched.

In a recent New York Times article titled "How the U.S. Lost Out on iPhone Work," the case for why the American manufacturing sector is doomed begins and ends with one word -- wages. The article states that Foxconn, the company that employees hundreds of thousands of Chinese workers to build and assemble Apple products, pays many of their workers less than $17 per day to work 12 hour shifts, 6 days per week.

If you figure that the average worker there works approximately 50 weeks a year; the average worker is making a gross income of roughly $5,100 per year. Most amazing of all, Foxconn says that they could hire 3,000 people overnight without any problems.

It doesn't take an economics whiz to figure out that American manufacturing cannot compete in a global environment where people literally line up in hopes of landing a job that pays $17 a day.

But in the end, this isn't necessarily a bad thing.

To prove my point, ask any parent that is working as an assemblyman in manufacturing one simple question: Do you want your children to do the same line of work as you? Now that might seem to be a cold or arrogant statement, but I would guess that 90 percent of respondents would say no. And believe me, that is not to say that they are not good, honest, hard-working people. But most work these types of jobs in order to support their family so that their children can go on to live better lives than they had, not to repeat the life they lived.

As Americans, it's time to start dreaming bigger and not dream of reliving the American life of the past 50 years. Our grandparents and great-grandparents did not live through a depression and win two World Wars in order for us to work at the same factory as they did. They did it so that freedom and the American spirit would live on; building an America that was far greater than the one they left us.

Augmented reality makes Thundercats packaging way cooler than the toys themselves

What happens when the toy packaging becomes more exciting than the toy itself? It's an interesting experiment that's now seeing the light of day courtesy of Bandai's new Thundercats and Ben 10 toys, which come to life through a smartphone screen via augmented reality. Tim Cook: Apple TV IS Still A Hobby, But I Couldn?t Live Without It

He stated that Apple sold more than 2.8 million Apple TV units last fiscal year with 1.4 million moved within Q1 2012 (a new record for the device). ?Our Apple TV product is doing quite well? but in the scheme of things, we still classify Apple TV as a hobby. UN sets stage for blazing fast new mobile devices (AP)

GENEVA ? A United Nations telecom meeting has approved the next generation of mobile technology, which experts say will make devices 500 times faster than 3G smartphones and eliminate the wait time between the tap of a finger and the appearance of a Web page.

The technology will be used immediately for planning changes to equipment but it could take two years to show up on consumers smartphone, tablets and other devices because of the time it takes to get to production, International Telecommunication Union spokesman Sanjay Acharya said Thursday.

The differences between present technology and the new standards for IMT-Advanced are like comparing dial-up Internet to fiber-optic cables, say officials at the U.N. agency responsible for information and communication technology.

"This means absolutely no time to get a page open," said Francois Rancy, head of the agency's radiocommunication bureau.

The technology hasn't been available until now because the U.N. must first approve of the international standards for its use.

The IMT-Advanced system uses radio-frequency spectrum much more efficiently, and devices built with it will need less bandwidth to access the Internet, stream videos and transfer data. That means those devices could deliver blazing fast messages, video chats and even high-definition TV.

The new standards for what some call "true" 4G, or fourth generation of mobile wireless standards, were approved by the ITU Radiocommunication Assembly at its meeting this week in Geneva. ITU set the requirements for 4G service in 2009.

In December 2010, ITU said some current technologies such as LTE and WiMax could be billed as forerunners to 4G, even though they don't meet the requirements of the IMT-Advanced system.

The 2G, 3G and 4G families of standards have been set by the International Telecommunication Union to define the services and download speed provided by networks.

The current 3G mobile technology, known as International Mobile Telecommunications, has been widely used since 2000.

Rancy said the new IMT-Advanced systems will deliver "a much higher quality and a much higher bit rate, typically of the order of 100 megabits per second."

A bit is a measure of data, so the new technology would allow devices to obtain data fast enough that most TV shows could be downloaded within about 20 seconds, and CDs within about a minute.

"This is a huge leap," Rancy said. "This is what people are really asking for now."

(AP) ? Tim Tebow needs more R&R than anyone thought.

The Broncos quarterback played through rib, lung and chest injuries he sustained in Denver's 45-10 loss at New England in the AFC divisional playoffs last weekend.

He won't need surgery, is expected to make a full recovery with some down time and his offseason training program shouldn't be affected in any way.

ESPN first reported Wednesday that Tebow got hurt on a third-quarter tackle, then had trouble sleeping because of the pain and underwent an MRI on his chest Monday.

Team spokesman Patrick Smyth said that while he couldn't confirm the exact extent or nature of the injuries due to team policy, he acknowledged that Tebow finished the game in considerable pain.

Backup Brady Quinn quickly got ready to go into the game after Tebow was hit by Vince Wilfork and Rob Ninkovich, but Tebow stayed in and finished up.

"It's just the physicality of playing football. Sometimes you get hit and it can hurt a little bit. But, I wanted to play a lot of the game," Tebow said after the game.

The outcome had long been decided by the time Tebow got hurt.

"I just wanted to show character. You just continue to fight and it doesn't change who you are, how you play, how you go out there, you should be the same at all times," Tebow said. "That's what I wanted to show, it didn't matter if it was the first play or the last play or you were down by 42. I was going to be the same player and I was still going to give everything I have. Because that's all I have to give."

Tebow wasn't in the locker room during a one-hour media window on Sunday, emerging with a smile from the trainer's room as reporters were filing out as the players streamed to their end-of-season meeting with coach John Fox.

On Monday, Broncos boss John Elway declared Tebow the incumbent starting QB entering training camp next summer and reiterated his plan to work with him during the offseason to help polish his passing game.

Tebow went 8-5 as the Broncos starter after supplanting Kyle Orton following a 1-4 start. He engineered a six-game winning streak that included four straight fourth-quarter comebacks that sent Tebowmania into full pitch.

He faded at the end, losing his last three starts, including one to the Kansas City Chiefs and Orton, but the Broncos backed into the playoffs nevertheless at 8-8 as champions of the middling AFC West.

Tebow had the best game of his pro career in the wild card round, when he averaged 31.6 yards per completion, the best in the NFL in 40 years, and threw an 80-yard touchdown pass to Demaryius Thomas on the first play of overtime for a 29-23 win over heavily favored Pittsburgh and the league's No. 1 defense.

That was Denver's first playoff game in six seasons.

While the Broncos brass was delighted at returning to the postseason party a year after a franchise-worst 4-12 season, they said the 35-point loss to the Patriots showed just how far they need to go to return to the AFC's upper echelon.

Tebow, who didn't get the first-team snaps during training camp or for the first month of the season, realizes he has a long way to go himself.

"Just work and improve, fundamentals, understanding defenses, footwork, everything," he said.

Tebow might also have to get accustomed to a new offensive coordinator in 2012. Mike McCoy has interviewed for head coaching vacancies in Miami and Oakland.

McCoy is a hot commodity after retooling Denver's offense midstream to capitalize on Tebow's unique skill set. He implemented the read-option that turned the NFL on its ear at midseason and resulted in the Broncos soaring to the top of the league in rushing.

Tebow ran for 660 yards, most by a quarterback in team history, in the regular season and another 63 in the playoffs, leading to concerns among some that he was exposing himself to injury. But Tebow noted that he actually takes glancing blows, if any, from smaller defenders while on the run, making him less vulnerable than when he stays in the pocket and might get sandwiched by 300-pound linemen.

He took every snap for Denver after replacing Orton at halftime Oct. 9 against San Diego.

Tebow ran for six TDs in the regular season and one in the playoffs while averaging 5.3 yards a carry. But he completed just 46.5 percent of his passes last season and just 40.4 percent in the playoffs.

"We're always looking for balance," Elway said. "Balance is what we won Super Bowls with."

Elway and Tebow are eager to see what a difference an offseason can make ? they didn't have that luxury last year during the NFL lockout.

"I feel like I've improved a lot in a lot of different forms of my game," Tebow said. "And I continue to improve and continue to get a lot better, and I believe I can, and I'm looking forward to putting in work."

Cruise survivors: 'There was so much chaos'

An American mother and daughter aboard the cruise ship that grounded off the coast of Italy Friday described a scene of chaos as passengers fended for themselves to climb aboard lifeboats.

"The crew members were running around like the actual passengers," Maria Papa told Ann Curry live on TODAY Tuesday. "They couldn't answer any questions to anyone; there wasn't anybody speaking English...there was so much chaos."

Papa said she doesn't blame for the frenzied crew, instead citing lack of direction from the liner's captain, Francesco Schettino, who now faces possible charges for abandoning ship and manslaughter. At least 11 people died and up to 29 people are still unaccounted four days after the Costa Concordia's sinking.

"I think if the captain took more of a hand on it, then I think the crew would have been better able to understand what was going on," she told Curry.

Her daughter and travel partner Melissa Goduti, of Wallingford, Conn., told NBC News of the horror aboard the ship when it crashed against the rocks off the small island of Giglio Friday night: "You could definitely hear the boat hit something ? it was like the boat leaned over at a 70 degree angle.

"Everything was pretty much falling; dishes were falling, trash cans were falling, everything was falling."
Goduti said.

"There was no one in charge of our lifeboat," Goduti told Curry. "We had one (ship employee) who spoke English..and she ended up taking off and leaving. She said she needed to find her friends. So there's no one from Costa Cruise Lines who ever said, 'OK, stay at this lifeboat; this is what you're doing.'"

Papa and Goduti managed to flee the ship; a particularly harrowing experience for Papa because she doesn't know how to swim. "We went to get on one boat when they had finally sounded the alarm, and the door would not open on that lifeboat," she told Curry. "Someone grabbed my hand and we went to the next boat."

While the pair made it to shore safely, Papa and Goduti are angry about reports that Captain Schettino exited the boat before the ship was cleared of passengers.

"It's just astonishing that someone would actually do something like that," said Goduti. Crew members, she said, didn't even seem to know where they were, alternately reporting they were off the coast of France or Italy.

"They had no clue," Goduti told Curry. "No one informed them. They said the captain (said) if it was an emergency he would sound the alarms. It took an hour and a half for him to sound an alarm."

An emergency drill was scheduled for the day after the accident, said Goduti.

"(On other cruises), within one hour of getting on board, it's mandatory, you have to go to this drill," she said. "They take your sea pass, they scan it and they make sure that every single passenger was there. And they tell you if anything were to happen, that you are going to scan your sea pass and we're going to know who got off the ship and who was still on the ship, so they know who to look for.

"(The Concordia sent) the crew members back on to find people who they've never accounted (for)."

Added Papa, "I believe the cruise should have been more prepared."

"Starbuck" wins audience prize at Palm Springs fest (Reuters)

LOS ANGELES, Jan 15 (TheWrap.com) ? The Canadian comedy "Starbuck," about a class-action lawsuit against a prolific sperm donor by 142 of the children he fathered, has won the Palm Springs International Film Festival's audience award for the festival's best narrative feature, PSIFF announced at an awards luncheon on Sunday.

The documentaries "The Girls in the Band," about female jazz musicians, and "Wish Me Away," about country singer Chely Wright's decision to come out as a lesbian, tied for the audience award for documentary.

The films were chosen from the Palm Springs lineup of 188 films from 73 countries. The festival presented 40 of the 63 entries in this year's Oscars Best Foreign-Language Film race, and a number of those films figured in the jury prizes that were given out at the luncheon as well.

All three of the awards given by the FIPRESCI juries, which are made up of international film critics, went to Oscar entries. Bela Tarr's "The Turin Horse," Hungary's entry, won the FIPRESCI Award for best feature; Matthias Schoenaerts, the star of the Belgian entry "Bullhead," was named best actor; and the female ensemble cast of "A Separation" shared the award for Best Actress.

Italy's entry, "Terraferma," won the HP Bridging the Borders Award, which goes to a film "that promotes bringing the people of our world closer together."

Other awards went to the documentary "The Tiniest Place" and the Slovakian film "The House."

'Eternal leader' Kim Jong-il's body to be enshrined

North Korea said Thursday it will enshrine?Kim?Jong?Il's body in the palace housing his father, the national founder, deepening its veneration of the?Kim?dynasty as the country transfers power to a third generation of the family.

The North's state media have sought since?Kim?Jong?Il's death on Dec. 17 to show his son,?Kim?Jong?Un, as a strong, confident military leader, but outside observers are watching to see if he can impose his will over the military and government as strongly as his father did during 17 years of absolute rule.

North Korea has quickly handed?Kim?Jong?Un a slew of his father's prominent titles and repeatedly connected him with his father and grandfather in an effort to add legitimacy to the young leader. North Korea also has stepped up propaganda praising?Kim?Jong?Il's works and vowed to uphold his policies in what is seen as an attempt to justify the hereditary power transfer.

On Thursday, the North's state media called?Kim?Jong?Il?the "eternal leader" ? reminiscent of his father's title ? and said his body will be displayed at Pyongyang's Kumsusan Memorial Palace, where the embalmed body of?Kim?Il?Sung has been lying since 1995, a year after he died.

It was unclear whether their bodies would be in the same room.

The new name for?Kim?Jong?Il's birthday, "Day of the Shining Star," is another link to?Kim?Il?Sung, whose birthday is called the "Day of the Sun."

"Shining Star" also was the name given by North Korea to what it says was a satellite it launched into space in April 2009, but that the United States says was a long-range rocket test. The launch stoked regional tensions and earned North Korea international sanctions and condemnation.

The new measures reflect North Korea's "unanimous desire ... to hold the great leader Comrade?Kim?Jong?Il?in high esteem as the eternal leader of the party and the revolution," the Political Bureau of the Workers' Party's Central Committee said, according to the official Korean Central News Agency.

North Korea is boosting "the cult of personality surrounding?Kim?Jong?Il" as it links him with?Kim?Il?Sung, said Yang Moo-jin, a professor at the University of North Korean Studies in Seoul.

On Thursday, North Korea's state television showed photos of a smiling?Kim?Jong?Un gesturing in a manner similar to his father and wearing a similar parka as he spoke to military officers and inspected construction sites.

Cricket's Muve Music tops 500,000 subscribers (AP)

LOS ANGELES ? Muve Music, the all-you-can listen music plan offered to subscribers of prepaid wireless carrier Cricket, has attracted more than 500,000 subscribers in its first year of operation.

The milestone announced Monday marks substantially quicker growth than some of Muve's competitors, which include MOG and Rdio, thanks in part to the service being bundled into a monthly cellular plan that includes unlimited talk, text and Web access for as little as $55.

Muve is the second largest music subscription service in the U.S. behind Rhapsody, which has 1 million subscribers. Swedish service Spotify says it has 2.5 million subscribers worldwide, but it hasn't disclosed its U.S. subscriber count since launching in the country last July.

"The growth rate for the service continues to accelerate and we couldn't be more excited," said Jeff Toig, general manager of Muve Music.

In September, Cricket expanded the Muve offering nationwide at retailers, including Wal-Mart Stores Inc. and Amazon.com Inc., using a roaming arrangement with Sprint Nextel Corp.

Cricket is a unit of Leap Wireless International Inc., the seventh largest cellphone carrier in the U.S. with some 5.9 million customers at the end of 2011.

The company has said that Muve has become a key way to attract new subscribers, and Cricket added 413,000 net new subscribers last year.

About 60 percent of Cricket's new customers in December joined by buying a smartphone powered by Google Inc.'s Android operating system or subscribing to Muve, the company said.

Toig said the company is seeing indications that Muve customers are highly attached to the service and are less likely to drop their cellphone plans as a result. Overall, Leap said that "churn," or the percentage of customers who drop cellphone service every month, fell to 3.7 percent to 3.9 percent in the fourth quarter of 2011, from 4 percent a year earlier.

Muve users on average download 300 songs to their phones every month and spend about 40 hours a month listening to the music.

Leap shares rose 430 cents, or 5 percent, to $9.05 in afternoon trading Monday.

Guantanamo closure hopes fade as prison turns 10 (AP)

SAN JUAN, Puerto Rico ? Suleiman al-Nahdi waits with dozens of other prisoners in a seemingly permanent state of limbo five years after he was cleared for release from Guantanamo Bay.

"I wonder if the U.S. government wants to keep us here forever," the 37-year-old al-Nahdi wrote in a recent letter to his lawyers.

Open for 10 years on Wednesday, the prison seems more established than ever. The deadline set by President Barack Obama to close Guantanamo came and went two years ago. No detainee has left in a year because of restrictions on transfers, and indefinite military detention is now enshrined in U.S. law.

The 10th anniversary will be the subject of demonstrations in London and Washington. Prisoners at the U.S. Navy base in Cuba plan to mark the day with sit-ins, banners and a refusal of meals, said Ramzi Kassem, a lawyer who represents seven inmates.

"They would like to send a message that the prisoners of Guantanamo still reject the injustice of their imprisonment," said Kassem, a law professor at the City University of New York.

Human rights groups and lawyers for prisoners are dismayed that Obama not only failed to overcome resistance in Congress and close the prison, but that his administration has resumed military tribunals at the base and continues to hold men like al-Nahdi who have been cleared for release.

Critics are also angry over the president's Dec. 31 signing of the National Defense Authorization Act, which includes a provision allowing indefinite military detention without trial.

"Now, we have Guantanamo forever signed into law," said Andrea Prasow, senior counterterrorism counsel for Human Rights Watch. "Instead of pushing forward with the agenda of closure, he has accepted the idea of indefinite detention for the duration of some undefined hostilities."

White House press secretary Jay Carney said Monday that Obama still wants to close Guantanamo because "it's the right thing to do for our national security interest," a view that he says is shared by senior members of the military. He noted President George W. Bush and Sen. John McCain, while running for president in 2008, also supported closing the prison.

"The commitment that the president has to closing Guantanamo Bay is as firm today as it was during the campaign ... I think this is a process that faces obstacles that we're all aware of and we will continue to work through them," Carney said.

Today, Guantanamo holds 171 prisoners and it's an odd mix. Thirty-six await trial on war crimes charges, including the alleged mastermind of the Sept. 11 attacks. There are 46 in indefinite detention as men the U.S. considers dangerous but who cannot be charged for lack of evidence or other reasons. The U.S. wants to release 32 but hasn't, largely because of congressional restrictions, and 57 men from Yemen, like al-Nahdi, aren't being charged but the government won't let them go because their country is unstable.

"There is not a thing keeping them from going home except that our clever government is waiting for conditions to improve in Yemen, where they have only deteriorated," said John Chandler, a lawyer based in Atlanta, Georgia, who represents al-Nahdi.

Few expected Guantanamo to reach this milestone. The prison, which occupies a portion of the 45-square-mile (115-square-kilometer) U.S. base at the southeastern corner of Cuba, started as an impromptu place to hold men scooped up at the start of the Afghanistan war, a mix that turned out to range from hard-core al-Qaida members to hapless bystanders.

Al-Nahdi seems to be in the middle. He was detained because he attended an al-Qaida-linked training camp in Afghanistan but he was not accused of any specific attacks on U.S. forces. The military classified him as a "low level" mujahedeen who could be transferred out of Guantanamo, where he has been held since June 2002.

The first prisoners, brought to the base shackled and hooded and clad in bright orange jumpsuits, were kept in outdoor cages and interrogated in wooden huts when they arrived on Jan. 11, 2002. With detainees later kept in steel mesh cells, the population grew to nearly 700 by mid-2003.

From the start, the camps seethed with tension. Prisoners, some subjected to harsh interrogations and sleep deprivation, staged mass hunger strikes, and banged on their cell doors for hours and hurled bodily fluids at guards.

In ensuing years, the military erected a modern prison complex virtually indistinguishable from a typical jail, keeping most men in communal blocks with amenities such as video games and cable TV.

U.S. officials have rejected most allegations of abusive conditions, and reports of clashes with guards and turmoil have dropped along with the decline in the prison population.

But the U.S. government also decided Guantanamo's reputation was more trouble than it was worth and began trying to empty it under Bush. His administration released 537 prisoners, transferring them to other countries or freeing them outright.

Under Obama, Congress balked at releasing prisoners, citing concerns that some already let go had rejoined the Taliban or al-Qaida. Congress imposed a requirement that the Defense Department certify a prisoner did not pose a threat if released, a guarantee that officials said was nearly impossible to grant. The law Obama signed Dec. 31 softened the language, but it's been a year since a single man has been transferred out.

"These are men who were in their early 20s when they were picked up and now they are in their early 30s and a significant amount of their lives has slipped away while this debate has gone on and on and on," said Cori Crider, a lawyer for the British human rights group Reprieve who represents several Guantanamo prisoners.

Zachary Katznelson, a lawyer for the American Civil Liberties Union, said Congress was more interested in scoring political points, and should listen to security experts.

"We are not talking about releasing anyone who is dangerous. We're talking about releasing people who the intelligence and military communities have unanimously agreed should be released," Katznelson said.

Congress also has prohibited moving any Guantanamo prisoners to the U.S. for detention or trial, which effectively blocked Obama's goal of closing the prison by January 2009 and trying the self-proclaimed mastermind of the Sept. 11 attack, Khalid Sheikh Mohammed, and others accused of war crimes in a civilian court. Mohammed is expected to be arraigned at the base later this year.

Congress also stripped the prisoners of the right to challenge their detention in the courts by filing writs of habeas corpus. The Supreme Court returned that right, but the courts have said the U.S. can still detain men even if there is little evidence against them and no intention of charging them. When prisoners have won their cases in a lower court, the government has appealed and won.

With such a bleak legal landscape, Chandler and his co-counsel withdrew al-Nahdi's appeal rather than face certain defeat. It's made for difficult meetings when the lawyers must explain why so many others, including prisoners who were convicted of war crimes, have been released.

"He says: 'How come I can't go home? I've never been charged and I'm never going to be charged. And of course, I have no answer to those questions," Chandler said.

North Korea to top agenda at Lee-Hu summit in China (Reuters)

SEOUL (Reuters) ? South Korean President Lee Myung-bak will this week ask China to use its influence to lean on North Korea to show restraint amid a delicate transition to a new leadership in Pyongyang focused on projecting a militaristic image.

Lee will hold a summit with China's president, Hu Jintao, in Beijing and will "discuss ways to develop the strategic partnership between the two nations and cooperative measures for peace and stability on the Korean Peninsula," the South Korean president's office said in a statement.

Lee's three-day state trip to China, his second in four years, starts Monday.

The South has said its primary foreign policy goal this year is maintaining stability on the divided peninsula as its unpredictable neighbor embarks on a third generation of dynastic rule following Kim Jong-il's death last month.

Little is known about Kim's chosen successor, his son Kim Jong-un, who in his late 20s and who will be relying on a small circle of trusted members of the military and political elite to act as minders while he cements his grip on power.

As part of efforts to consolidate his power, state television in Pyongyang released a documentary Sunday containing footage of the young Kim watching a 2009 long-range rocket launch with his father. He was also shown driving a tank.

The 50-minute documentary, aired on what South Korean media speculated was Kim Jong-un's birthday, offered no new personal details or insights into his thinking.

Analysts say the young Kim may order a "provocation," such as a small-scale military attack or nuclear or missile test, to burnish a hardline image with the powerful military.

In line with his push to project a songun, or military-first, policy, Sunday's documentary quoted Kim Jong-un as saying he was determined to wage war if any enemies intercepted the 2009 rocket launch.

Over the past week, the North, which has twice tested nuclear devices, has also stepped up its use of hostile language against the South.

Both South Korea and the United States have urged China, the North's main ally and benefactor, to help restrain the new leadership from staging any hostile acts.

China voiced its support for the North's new leadership soon after Kim's death was announced.

South Korea's ambassador to China, Lee Kyu-hyung, said last week that the South would continue to raise the issue of China's unwillingness to condemn North Korea when it provokes the South.

"PROBLEMATIC"

In 2010, South Korea criticized China for refusing to censure North Korea for torpedoing a South Korean warship, killing 46 sailors. The North denied it sank the vessel.

"It is problematic because China has appeared to take an attitude of protection and support for North Korea, while the North sometimes makes military provocations and implements some incorrect policies," Ambassador Lee Kyu-hyung told the South's Yonhap news agency.

South Korea would "continue to raise the issue and make efforts to persuade" China to change that attitude, he said.

China backed North Korea during the 1950-53 Korean War while the United States fought for the South. The United States still has about 28,000 troops in South Korea.

Lee and Hu are also expected to discuss how the two nations will push preliminary talks to launch formal negotiations for a free trade agreement.

Since 2008, South Korea and China have held a series of joint feasibility studies on a possible free trade deal and reached an agreement to exchange their views on sensitive issues.

The two leaders will also discuss the rising number of Chinese fishing boats caught illegally fishing off South Korea's west coast. Last December, a South Korean coastguard was killed while trying apprehend a Chinese vessel.

Netflix close to signing deals with Sony, Disney, Paramount and ITV, to debut in the UK soon? (update: pricing pegged at ?5.99/month, website live)

Those with a PS3 in the United Kingdom might have gotten a sneak peek at a placeholder, but according to The Guardian, apparently its proper "early 2012" launch isn't far off. Purportedly the video streaming service is close to signing rights to content from Sony, Disney and Paramount, which'll join existing agreements with Lionsgate, Miramax and MGM. But it isn't just studios, as Channel 4 and ITV are supposedly close to joining the UK bash as-well. If everything goes to plan, most of the British Isles will be treated to an ad campaign that'll reveal all next week. Game on, Lovefilm.

Update: Well, it looks like we don't have to wait until next week for all of those details after all. Some Google ads have now started appearing in searches for Netflix that peg the price at £5.99 per month (or about $9), and also confirm that the service is headed to the Wii and Xbox 360 in addition to the PS3. Unfortunately, that netflix.com/UK page isn't functional just yet.
